Information on Act 66 of 2021
On June 30, 2021, Gov. Tom Wolf signed Act 66 of 2021 into law, which permits students who were enrolled during the 2020-2021 school year to repeat their grade level in an effort to make up for any lost educational opportunities due to the COVID-19 pandemic, even if the student met the requirements to be promoted to the next grade level.
Additionally, Act 66 permits students with disabilities who were enrolled during the 2020-2021 school year and turned age 21 during that time, or between the end of the 2020-2021 school year and the beginning of the 2021-2022 school year, to attend a school entity during the 2021-2022 school year and receive services as outlined on their most recent Individualized Education Program (IEP) with all the protections under the Individuals with Disabilities Education Act (IDEA).
Parents/guardians interested in re-enrolling their child who is under the age of 18 under the above options for the 2021-2022 school year must submit the Act 66 of 2021 Student Grade Level Retainment Notification Form to Mr. Timothy Mahoney, Fox Chapel Area’s director of special education and pupil services, at firstname.lastname@example.org on or before July 15, 2021. Please note that students ages 18 or older who plan to repeat a grade level during the 2021-2022 school year must complete and submit their own form. For a student with a disability who turned 21 during the time periods listed above, both the parent/guardian and the student must complete the form. Once the school district receives the Student Grade Level Retainment Notification Form, a school counselor or principal will reach out to the student's family.
If you have any questions about Act 66 or its implications, please contact Mr. Mahoney at the email address above or (412) 967-2435. Additionally, the Pennsylvania Department of Education website contains a number of frequently asked questions.
